These general terms and conditions of sale (“General Terms and Conditions of Sale”) apply to any order you place through our Website. These General Terms and Conditions of Sale apply regardless of how you access the Website. You must read these General Terms and Conditions of Sale carefully. By placing an order through the Website, you confirm that you have read, understood and agree to these General Terms and Conditions of Sale in their entirety and you agree to be bound by them. If you do not agree to these General Terms and Conditions of Sale in their entirety, you must not order any product or service through the Website.

Our cages, nets and traps were originally designed for the study of butterflies and moths, but are also suitable for the study of a variety of other insects.  However they are not suitable for use with or exposure to species which are likely to bite, claw, or cause similar failure of fabric products.  Any fabric item can be damaged by piercing, cutting, or abrasion/rubbing in the environment in which it is being used.  To avoid damage we recommend that you carefully locate your cages or traps to avoid uneven, sharp, or rough surfaces or objects, and also minimise the potential for contact with predatory creatures.  Climate specific tests on our fabrics have shown they can withstand a minimum of 12 months UK weather.  However due to the wide range of other parameters outside our control we are unable to advise on, or guarantee the durability of, our materials or products in any given physical environment or for any specific purpose.

We sell small samples of material for testing purposes so that customers can test (or otherwise consider) whether our material is fit for their specific purpose before making their main purchase.

We do not replace products which have suffered failure during use as a result of chemical or mechanical damage (caused by, for example but not limited to: gnawing, abrasion, piercing, and so on) or from failure to follow our erection, cleaning, or storage instructions.  Minor holes in our fabrics can be mended by hand darning, larger holes must be patched.

The insects pictured on our website illustrate a small number of the wealth of species in the UK and worldwide; they are not necessarily indicative of species that will be suited to rearing or study using our products.

OPENING AN ACCOUNT AND PLACING AN ORDER
To place an order, you can open an account with us (“Your Account”) which will require you to provide some compulsory personal information. Alternatively, you can choose to place your order via the guest checkout.  Please see our Privacy and Cookie Policy for more information on what personal information and how that personal information will be used and stored.  You confirm that all information and details provided by you to us (including on registration) are true, accurate and up to date in all respects and at all times. You can update or correct your details at any time by going to Your Account.  When you create an account we may provide you with and/or ask you to use passwords or other means to allow you to access certain areas of the Website and/or to maintain your account security. It is your responsibility to maintain the confidentiality of your password and account information. JoTech Ltd shall not be liable to any person for any loss or damage which may arise as a result of any failure by you to protect your password or account.  When you order through the Website via our guest checkout you will still need to provide us with certain compulsory personal information in order for us to process your order. Acceptance of Your Order
Completion of the online checkout process does not constitute our acceptance of your offer to purchase products or services from us. We will notify you by email as soon as possible to acknowledge that we have received and are processing your order. Our acceptance of your order will take place only when we despatch the product(s) or on commencement of the services that you ordered from us.  Prior to despatch of the product(s) JoTech Ltd has the right to decline an order for any reason, including legal and regulatory reasons.  The duration of our contract with you will start from when you receive the order despatch email and last until the last day of your right to return the products.  If we cannot supply you with the product or service you ordered, we will not process your order and inform you of this in writing (via email) and, if you have already paid for the product or service, we will offer you the option to wait for the product to become available, or will refund you in full as soon as reasonably possible, but in any event no later than 14 days after receipt of your payment.  If the fulfilment of an order (or any aspect of it) would be illegal or unlawful, including by reason of breach of export controls or sanctions rules, JoTech Ltd has the right to stop or cease to fulfil the order at any time, including after  notification to you that the order has been received and is being processed. You acknowledge that JoTech Ltd shall not incur any liability in such circumstances.

Please note that in the case of any bespoke products it is your responsibility to ensure that your instructions are clear and complete and that we are therefore able to interpret your requirements correctly.  It is also your responsibility to ensure that goods are safe and fit for purpose. Your approval of a bespoke design and / or test net must only occur when you have considered and are thoroughly satisfied with all aspects of the fabric, design, and fit, have considered how the net will perform in its final environment, and when any design or material limitations of the product (including possible points of failure) fall within your project parameters.  We therefore recommend that you thoroughly test our products (including any sample materials, cage, trap, net, or frame) ideally in the environment in which it will be used, before signing-off production. We will produce all items to the specification and / or dimensions laid out in our business quote, but once the product has been approved cannot be held responsible for any design error, inaccuracy, lack of clarity or omission in your brief, or failure of the product we have supplied to perform as expected (including material failure).

 
PAYMENT

Accepted Payment Methods

You may pay using any payment method specified in the checkout process. JoTech Ltd may change the payment methods at any time but this will not affect any existing order. The availability of a certain payment method may depend on your geographical location.

Payment

If you place an order on our Website, then you acknowledge and agree that: (i) JoTech Ltd will charge you through the payment method you have selected for your order and such other amounts that may accrue in connection with the order; (ii) that you will provide valid and current information for (a) yourself and (b) if applicable, another person, but only if you have first obtained their express consent to do so; (iii) that JoTech Ltd may use tools, software or services of payment processors to process transactions on their behalf; and (iv) if your payment is not received by JoTech Ltd for any reason from your card issuer, you agree to promptly pay all amounts due upon request and using the method that JoTech Ltd reasonably prescribes.

Currency

The price of products is shown in UK Pounds Sterling (£ GBP).  You will be charged according to the applicable exchange rate at the time your order is accepted.

TAXES AND IMPORTATION CHARGES

 All our products are subject to the standard rate of 20% VAT for orders placed in the UK.  For certain shipping destination countries and/or products, you may be required to complete paperwork and/or pay applicable taxes when the goods reach the destination country. You acknowledge that such taxes are set by the shipping destination country and therefore may vary from country to country.  You also acknowledge that you will be fully responsible for the completion of such documents and for paying all applicable taxes directly to the relevant authority (and for reclaiming them in the event of a cancellation of your order or the return of products, to the extent permitted in the these Terms) as determined by the authorities of the shipping destination country, and JoTech Ltd shall have no responsibility or liability in connection with the foregoing.  In addition, should the shipment be refused entry to the country, confiscated or destroyed by the relevant overseas customs agency as a result of your failure to arrange documentation or to pay charges relating to importation, JoTech Ltd will not: pay for or supply you with replacement goods, reimburse you any sums you have already paid to us, or be held liable for any consequential loss or any other costs caused or incurred by you as a result of your failure to successfully complete the process of importation.

SHIPPING AND DELIVERY

Shipping

Our shipping charges are calculated on checkout and include labour, packaging, and postage.  Your goods will normally be shipped by Royal Mail or Parcelforce, however on occasion we do use third party agents who arrange onward shipping using a variety of couriers.  A signature will normally be required on all items worth more than £20.  Please ensure there will be someone at your nominated delivery address to accept the shipment.


Delivery (including delivery charges and timescales)

Delivery charges and timescales vary depending on the products ordered, the service selected and the delivery address.  If no fixed date or timeline has been agreed upon, we aim to perform our deliveries within 30 days.  Please note that certain products may be subject to alternative delivery charges, restrictions and/or timescales.  Delivery to customers outside the UK may take longer than 30 days due to customs clearance or other importation factors.  If delivery cannot be made to a customer due to the customer not being present at the address at the time allotted by the carrier or if a customer refuses to accept the products, JoTech Ltd reserves the right to deduct the outward shipping cost from the customer's refund for the order.  All risk in the products you order (including risk of loss and/or damage to the products) shall pass to you when they are delivered to the delivery address or safe place specified in your order.

Delays

Where the supply of your product(s) or service(s) is delayed or prevented for reasons beyond our control (for example, courier strikes, material shortages, import delays or higher than anticipated demand) we will make every effort to keep you informed but shall be under no liability to you for such delay or failure. For the avoidance of doubt, this paragraph does not exclude or effect in any way any statutory right that is afforded to you to cancel an order when a product is delayed or not provided.  From time to time our office is temporarily closed for special occasions (eg Christmas) which can cause delays or disruption.  For such events we post a prominent notice on our Website giving estimated standard dispatch dates.

LOST, DAMAGED, OR INCORRECTLY SUPPLIED PRODUCTS
Most of our products are manufactured in house, and every effort is made to ensure that these reach you in perfect condition.  If there is any problem with your purchase, please do not hesitate to contact us.  You should check all products you receive against your order. If the products you receive are damaged or incorrectly supplied on delivery then you must note the details of any damage or error in supply on the order documentation or if you are unable to view the items on receipt, you must inform us (by post, phone or email only) within two working days.  In the case of damaged goods, photographs that clearly show the nature and extent of the damage must be provided, as these will be requested by our courier.  Do not return the products to us unless we ask you to do so.  In the case of missing parts, we will supply these within 30 days.  In the case of damaged or incorrectly supplied goods, we will offer you a refund or exchange. Any refunds will be made within 14 days of our offer to the debit/credit card account provided when you placed your order and will be subject to our right to withhold amounts for products which are damaged on return or for which we arrange collection.

You agree that proof of delivery supplied by our delivery company is sufficient evidence to establish that goods have been received.  If you specifically ask us to leave an item with a neighbour, or in an unsecured or "safe" place (eg porch, outhouse, side-passage etc)  then this request is entirely at your own risk, and JoTech will not be held liable for any theft of goods or consequential loss which occurs as a result of us complying with your instructions.  With goods sent via the Royal Mail, please note that we may not be able to progress any order for lost goods until 15 working days after the approximate date on which goods should have been delivered - this is Royal Mail policy.

RETURNS AND REFUNDS - OUR GOODWILL POLICY
With certain exceptions as listed below, or where items have been purchased on behalf of a business or institution, if you are a UK customer and change your mind you can apply for a refund of unwanted goods under our goodwill policy.  Applications must be made within 14 days of the receipt of your goods.  To return your items, you will need to return all or part of your order within 14 days at your own cost through your preferred carrier.  Items must be unused, returned in the original packaging, and in a re-saleable condition.  If you choose to return any products to us, we will not be responsible for any loss or damage to them in transit and, for this reason, we recommend that you use a recorded delivery service. If returned products are lost or damaged in transit, we reserve the right to charge you (or not to refund any amounts attributable to) such loss or damage.  The following are excluded from the goodwill policy and cannot be returned: eGift Cards, made to measure (bespoke) orders, sales of net plastic or geotextile cut to length for your order, and orders which have been specifically manufactured to meet your quantity requirements (any order with 10 or more identical items).  If you are a non-UK customer please note you may have cancellation rights governed by local legislation. Nothing in these General Terms and Conditions of Sale will affect these statutory rights.

Within the UK please note that any refund will be the full price you paid for the goods less any non-recoverable transaction costs incurred by us.  Non recoverable costs include a] any PayPal, WIX Payments, credit or debit card, or bank transaction fees b] express or additional shipping costs over and above our lowest shipping charges (we will refund the equivalent of our lowest shipping price only); c] and deductions relating to wear, tear, or damage to the goods whilst in your possession (including during return shipping).  Outside the UK the refund will be for the invoiced price minus; the original shipping costs, and also minus a 20% re-stocking fee on the remaining balance.

PRODUCT AND SERVICE DESCRIPTIONS
We have taken reasonable precautions to try to ensure that prices quoted on the Website are correct and that all products have been fairly described. However, when ordering products or services through the Website, please note that:

• orders will only be accepted if there are no material errors in the description of the goods or services or their prices as advertised on this Website;

• packaging may vary from that shown on the Website;

• the weights, dimensions and capacities shown on the Website are approximate only;

• whilst we try to display the colours of our products accurately on the Website, the actual colours you see will depend on your monitor and we cannot guarantee that your monitor's display of any colour will accurately reflect the colour of the product on delivery; and

• all items are subject to availability. We will inform you as soon as possible if the product(s) or service(s) you have ordered are not available and we may offer alternative product(s) or service(s) of equal or higher quality and value.

LEGAL COMPLIANCE
You agree that you will not use, sell or supply any product(s) purchased from JoTech Ltd in an unlawful manner and, in particular, will comply with all export controls and sanctions rules.

Liability
Nothing in these General Terms and Conditions will affect your statutory rights and we will perform our obligations under these General Terms and Conditions of Sale with reasonable care and skill.  Any products we supply to you will be of satisfactory quality. If we deliver a product to you that is not of satisfactory quality, you can contact us for a repair or replacement or, where this is not possible, for a refund.  We are only responsible for losses that are a natural, foreseeable consequence of our breach of these General Terms and Conditions of Sale. We will not be liable to you if we are prevented or delayed from complying with our obligations under these General Terms and Conditions of Sale by anything you (or anyone acting on your behalf) does or fails to do or due to events which are beyond our reasonable control.  You must follow any advice we give you to keep products we supply to you safe (iincluding any instructions or product information provided with the products, or available on this Website). We cannot accept liability for damage to products we have supplied which is caused by your failure to follow this advice.  In any event we will not be liable for any losses related to any business of yours including (without limitation) lost data, lost profits, lost revenues or business interruption.

TERMS SPECIFICALLY RELATING TO THE PURCHASE OF eGIFT CARDS

These additional terms and conditions tell you about the legal terms and conditions which apply to your purchase and use of digital Ento Nets Gift Cards (eGift Cards) and apply to pounds sterling eGift Cards purchased online through the Ento Nets website (www.insectcage.co.uk).

 

Ento Nets reserves the right to update and change the terms and conditions of our eGift Cards at any time. This does not affect your legal rights. Use of your eGift Card constitutes acceptance of our Terms and Conditions and we therefore recommend you read them carefully. It is your responsibility to check these gift card terms from time to time to ensure you are aware of any changes which may have been made. eGift Cards remain the property of Ento Nets who maintains the right to cancel the card in its sole discretion in situations where it is deemed necessary to do so (such as to comply with applicable laws or as a result of circumstances beyond its control).

 

The value of your eGift Card can be redeemed online at www.insectcage.co.uk.  Only one gift card may be used per online order. Gift Cards may be used to pay for the whole or any part of an online order.

 

An eGift Card must be used within the redemption period, which is up to 24 months from the date of issue. After 24 months it will expire automatically.  A gift card cannot be used after the expiry date; any remaining balance will be removed and the card will become invalid and no longer available for use. We have no obligation to remind or inform you of a gift card’s expiry and it is your sole responsibility to ensure that any balance is used in full prior to expiry.

 

The eGift Card balance cannot be exchanged for cash or redeemed against the purchase of another card. 

 

The maximum amount that an individual eGift Card can hold is £100.00.  Ento Nets will provide you with specific denominations to choose from, or you can select any amount up to this maximum to load on to your eGift Card.

 

You are solely responsible for the safe keeping and security of your eGift Card. In cases where your eGift Card is lost or stolen, Ento Nets is unable to replace or reimburse the remaining balance on a card. Ento Nets cannot be held responsible for the any balance lost on an eGift Card as a result of theft or fraud. 

 

Any goods paid for using a gift card that are subsequently returned for a refund will be credited on a new eGift Card. If the total to be refunded is more than originally paid by eGift Card, then any remaining refund balance will be refunded to the other method of payment used by you (i.e. debit/credit card or cash).

 
PART D:  LEGAL TERMS

 

Exclusions of Liability
Except as expressly provided in these Terms and Conditions, we exclude all representations, warranties, conditions and terms (whether express or implied by statute, common law or otherwise) to the fullest extent permitted by law. We accept no liability for any losses or damages which are not reasonably foreseeable arising out of or in connection with these Terms and Conditions or your use of the Website.  These exclusions shall be governed by and construed in accordance with English law, subject to other mandatory laws which cannot be excluded in the country where you are resident. If any provision of these disclaimers and exclusions shall be unlawful, void or for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.  In addition, these Terms and Conditions shall not limit or exclude any other liability that we are not permitted to limit or exclude under applicable law.

Assignment and Third Party Rights
You may not assign or sub-contract any of your rights or obligations under these Terms and Conditions to any third party unless we agree in writing. We may assign, transfer or sub-contract any of our rights or obligations under these Terms and Conditions to any third party at our discretion. However, where we have engaged a third party to perform part of the contract with you, we remain liable towards you for the full performance of our agreement and also for the performance by the third party.  Only you, and JoTech Ltd shall be entitled to enforce these Terms and Conditions. No third party shall be entitled to enforce any of these Terms and Conditions, whether by virtue of the Contracts (Rights of Third Parties) Act 1999 or the applicable local legislation.

Waiver
No relaxation or delay by us in exercising any right or remedy under these Terms and Conditions shall operate as waiver of that right or remedy or shall affect our ability to subsequently exercise that right or remedy. Any waiver must be agreed by us in writing.

Severability
If any of these Terms and Conditions are found to be illegal, invalid or unenforceable by any court of competent jurisdiction, the rest of these Terms and Conditions shall remain in full force and effect.
